DPA

This Data Processing Addendum (“DPA”) forms part of the Terms of Service and applies to any customer of Romantic Technology GmbH who acts as a data controller under applicable data protection laws. It governs our processing of personal data on your behalf, in compliance with Article 28 of the EU General Data Protection Regulation (GDPR) and the Swiss nFADP.

Data‑Processing Addendum

Version 1.0 — Effective Date: 1st February 2025

(Automatically incorporated into the Terms for any customer who is a “controller” of EU/Swiss personal data.)

Item	Description
Parties	Controller: Customer. Processor: Romantic Technology GmbH.
Subject‑matter	Processing of personal data embedded in Grasshopper context (including prompts, component lists, plug‑in metadata) sent via Raven to Romantic Technology‑hosted or third‑party inference services.
Duration	Term of the main Agreement plus deletion period.
Nature & purpose	Collection, transmission, storage and analysis necessary to provide and improve Raven; optional analytics.
Personal‑data categories	Account identifiers, IP address, device info, prompt content, canvas context.
Data‑subject categories	End‑users of Raven (designers, engineers, students).
Sub‑processors	(i) Microsoft Azure EU; (ii) third‑party AI inference API (USA); (iii) Stripe, Inc. (USA) for payments; (iv) e‑mail/Mail service provider. Controller authorises these sub‑processors; Romantic Technology will notify Controller of replacements.
Security measures	Logical access limited to dev team; encryption in transit; encrypted Azure storage; role‑based IAM; regular backups; data‑subject‑request workflow.
International transfers	Romantic Technology enters into SCCs with US sub‑processors and applies additional measures.
Data‑subject assistance	Romantic Technology will forward and assist with DSARs, breach notifications and DPIAs.
Return or deletion	Upon termination Romantic Technology will delete or return all personal data unless EU/Swiss law requires retention.
Audits	Controller may audit once per year on 30 days’ notice (questionnaire or on‑site at Controller’s cost).
Liability	Subject to §9 of the Terms.
